My husband is in prison and I want a divorce.?

My husband is in prison until march of 2010 and I want this loser out of my life!!!! I want to get a divorce but I don’t know if it’s possible while he’s locked up. I was going to hire a cheap attorney and do most of the paper work myself. We have no kids, and no assets to split. If anybody has any suggestions they’d be GREATLY appreciated.
He is aware that I want a divorce buy prozac and he’s willing to cooperate so there’s no issues there.




Since he is wiling to cooperate, its considered an uncontested divorce. Uncontested divorces do not require the use of a lawyer, you can do them yourself.
It will only be easier since you have no kids or assets to split. You would get the papers, file them at the court and serve them to him. It should be relatively cut & dry…IF he cooperates. If he contests then you will need a lawyer.
at least you know where to have the papers served…
ask the county clerk for information or go to any courthouse and ask the price and where to go..you should be able to even call and ask for free
It is possible. However, that would be so wrong. Just wait for him to be released.
Jus be careful and make sure he knows and understands or (prison is alot of thinking and more criminal connections- when he gets out he doesnt try revenge or anything negative) i know alot of these dude they really dont care after a while and many have there own shit list when they get out. In the UK the judge must agree that your marriage is over and has irretrievably broken down. Grounds for divorce are:
-adultery
-unreasonable behaviour
-desertion – after two years
-two years’ separation, if you both agree to divorce
-five years’ separation, if there is no agreement to the divorce

I would think that unless he has been in prison for over 2 years (desertion) or 5 years (separation ), your best bet is unreasonable behaviour. I think you’ll find that deciding to live a life that gets you ‘banged up’ is considered unreasonable to most courts!
Don’t listen to anyone telling you to wait until he comes out, he had his chance to make a life with you but chose not to.
I’ve just reread your question before submitting it and realized that you might be American as you talk about an attorney instead of a solicitor, and I’m in the UK, but I can’t imagine the logic behind divorce will be too different even if the process may be. I”m answering anyway in case someone in the UK may be able to use the information.
