   Try going to court first (unless you have gone already), the judge will usually give you another court date so you can get one if you want…..

   You’re facing a DV assault charge 1-4 1 being a felony 4 a misdemeanor. Plead not guilty. Do not accept plead bargain until you understand the penalty! If the victim or witness are family and will not testify in court against you, Prosecutor will not take it to trial. If you accept a plead bargain you will have a DV criminal record, do 15 to 30 days of community services, require to take DV weekly classes which cost $25 to $100 a week. Which take 1 to 2 years to complete. Visit probation officer bi-weekly for 2 years. Btw you have to pass the class which some have a 50% failure rate.You will have a permanent ban (Life time ban) from possessing a firearm. Plead not guilty and you want to go to trail please set trail date, that’s if your family won’t testify. If you’re a real jerk and they testify you’ll get the same as above. If you are a jerk and It’s assault 1 or 2 a felony and you know the family will testify. The prosecutor will still bargain, they hate wasting Jury selections, Also if you do get the charges dismissed, if I was you I’d still take the DV classes. Think about it. The prosecutor will not select a jury , waste 12 citizens time, if he has no witnesses no victim willing to testify. I’m certainly not condoning anything you might have done. I just think the DV system is extremely hard on families. Also if convicted the Judge slaps a 1 year restraining order on you and you’re in more jeopordy if you try to contact the family member you assaulted. You will have to move out of the house. Not Guilty, Not Guilty, Not Guilty you do not want to be put in the DV system. A public defender should be able to explain the steps. Charges filed, Arraignment, Bond, Pre-Trial, Trial.
